SUBSTANCE ABUSE – EMPLOYEES:
1.0 Philosophy
1.1
1.2 The Spaulding High School District is
concerned about the effects of alcohol/drugs on its employees. The responsibility for an employee’s
behavior is with the employee.
1.3 Alcohol/drug abuse is treatable and
employees needing additional counseling and assistance will be offered
opportunities for self-referral and may be referred to community and service
agencies.
2.0 Definitions
2.1 During participation in any school-related activity,
when acting as an agent of
2.2 “Drug” means any controlled substance
as defined by state or federal statute or regulation.

3.0 No employee will unlawfully
manufacture, distribute, dispense, posses or use alcohol or any drug in the
work-place.
4.0 As a condition of employment, each
employee will notify the superintendent in writing of his/her conviction of any
criminal drug statute for a violation occurring on or in the workplace. The employee will notify the superintendent
no later than five days after such conviction.
Entry of a nolo contendere plea shall constitute a conviction for
purposes of this policy, as will any judicial finding of guilt or imposition of
sentence. Within ten (10) days of
notification from an employee, or receipt of actual notice of an alcohol or
drug conviction, the superintendent will notify any federal or state officers
or agencies legally entitled to such notification.

5.0 As a condition of employment, each
employee must abide by this school district policy. If an employee violates this policy, the
district will take appropriate action which may include, but is not limited to,
one or more of the following:
. Verbal counsel;
. Written reprimand;
. Suspension with pay;
. Suspension without pay;

Require enrollment in and successful completion of a substance abuse assistance
of
rehabilitation program;
. Dismissal, and/or;
. Referral to law enforcement
officials for prosecution if the employee has violated state
or federal
laws.
6.0 The Board will take such action in
accordance with district policies and regulations as well as applicable state
and federal law.
7.0 The pertinent contents of this policy
will be included in the employee handbook and distributed to each employee
annually.
8.0 The superintendent or his/her designee
will conduct a biennial review of the district student and employee drug
prevention programs as required by the
